This application has been filed for reception of additional document. The documents sought to be filed are of the year 1944 and the other documents are revenue records in respect of the suit property. 2.

Though the objection has been raised by the other side vehemently and the counter has also filed in this regard, this Court is of the view that the very first document sought to be filed is only a parent document which has a reference in the document filed by other side namely the respondent herein. At any event, merely allowing the applicants to file documents, will not amount to proving their case and permitting to file a document is one aspect and proving that document is a different aspect which has to be seen only in trial. Therefore, if at all any objection is raised with regard to that document, the same can be done only at the time of marking the document during the trial by the other side. As a matter of right, the respondent cannot object for very reception of document. It is the matter between the Court and the party seeking leave to file additional document. The only right available for the respondent or other side is to raise a valid legal objection at the time of marking the document.

In such view of the matter, this application is ordered. If at all the respondent has any legal objection, the same can be noted by the main Master at the time of marking the document.
