[Order of the Court was made by S.S.SUNDAR, J.,] Since the writ petition filed by the petitioner in WP.No.21335/2010 has been disposed of with a direction to the respondents to consider the Government Order in G.O.Ms.NO.326, dated 06.11.2008 and do the needful in accordance with the Government Order, any subsequent order which is not in tune with the direction of this Court, can be independently challenged by the petitioner herein.

2.It is also to be noted that the said Government Order was never interfered with. This Court has upheld the validity of the said Government Order relying upon the stand taken by the respondents in the counter affidavit. In case the respondents fail to implement G.O.Ms.No.326 dated 06.11.2008, it is open to the petitioner herein to seek appropriate relief as it is a different cause of action altogether. There is no necessity to clarify the judgment passed by this Court in the writ appeal.

3.Accordingly, this miscellaneous petition stands dismissed.
