ORDER

The petitioner states that a partition suit bearing O.S.No.172 of 2015 was filed by and between members of the petitioner's family and that properties were allotted to the petitioner's share as per the compromise decree issued therein. The petitioner also states that the shares allotted to other members of the family were conveyed by them under registered documents. When the petitioner presented a settlement deed settling the property allotted to his share in favour of his son, the registering officer orally declined to receive the same and take further steps for registration. Hence this writ petition.

2. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for the sole respondent. He submits that the registering officer would either register the document or issue a speaking order of refusal, if the document were to be re-presented.

3. Considering this submission, this writ petition is disposed of on the following terms:

(i) The petitioner is directed to re-present the settlement deed within two weeks from the date of receipt of a copy of this order.

(ii) Within two weeks from the date of re-presentation, the registering officer shall either register the document subject to fulfilment of other requirements relating thereto or issue a speaking order of refusal. (iii) No costs.
