The relief sought for in the present Writ Petition is to forbear the respondents 1 to 6 to accord any permission to open a liquor vending shop with or without Bar at Door No.4, in Old T.S.No.538, New T.S.No.538/2C, Narayana Pillai Street, Mayiladuthurai Town, Nagapattinam District.
2. The learned counsel for the petitioner made a submission that no liquor vending shop is functioning in the said Door No.4 and pursuant to the interim orders granted, the respondents have not open any liquor vending shop, 10 years lapsed.
3. The learned counsel for the petitioner brought to the notice of this Court that in the adjacent area, in a corner property, the respondents have opened a liquor vending shop. In respect of the said liquor vending shop, already there is a Writ Petition filed in W.P.No.2389 of 2020 and the said Writ Petition is pending.
4. In view of the fact that the present Writ Petition is filed seeking an order in the nature of injunction not to grant any permission to open a liquor vending shop at Door No.4 at Narayana Pillai Street, Mayiladuthurai Town, Nagapattinam District and the respondents admittedly had not opened any liquor vending shop in the said premises, there is no reason to keep the Writ Petition pending.
5. However, the grounds raised in the Writ Petition in respect of the public inconvenience in that locality may be placed before the petitioner in the subsequent Writ Petition filed in W.P.No.2389 of 2020.
6. With these observations, the Writ Petition stands
disposed of. Consequently, connected Miscellaneous Petition is closed. No costs.
