O R D E R

By the impugned order dated 27.02.2017 in C.M.P.No.1159 of 2017 in Crime No.233 of 2016, the learned Judicial Magistrate No.II, Pollachi, granted interim custody of the petitioner's vehicle to him, on certain conditions. One of the condition is that the petitioner has to deposit a sum of Rs.1,00,000/- before the Trial Court. Now the present petition has been filed to issue a direction to modify the said condition imposed in the order with regard to deposit of Rs.1,00,000/-. 2.Mr.C.Emalias, learned Additional Public Prosecutor, took notice for the respondent.

3.Heard both the sides.

4.Considering the facts and circumstances of the case and also that the vehicle never involved in any offence, the condition imposed by the learned Judicial Magistrate No.II, https://hcservices.ecourts.gov.in/hcservices/

Pollachi, in the order made in C.M.P.No.1159 of 2017 in Crime No.233 of 2016 dated 27.02.2017, in respect of deposit of a sum of Rs.1,00,000/- alone is modified to the effect that the petitioner shall deposit a sum of Rs.25,000/-. Rest of the conditions imposed by the learned Judicial Magistrate No.II, Pollachi, shall remain unaltered.

5.This petition is ordered accordingly.
