Teacher (English) by the fourth respondent, dated 02.03.2023, seeking pay fixation at par with her junior

(P.G.Teacher-Commerce) with effect from 01.06.2016 ; returned on 20.10.2023, on re-submission as per G.O.Ms.No.303 Finance (Pay Cell) Department dated 11.10.2017 and the proceedings of the second respondent in Rt.Ct.No.34750/L/E3/2023-1, dated 25.10.2023, within time stipulated by this Court.

ORDER

This Writ Petition has been filed for direction directing the third respondent to consider the proposal for rectification of pay anomaly of the petitioner submitted by the fourth respondent.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner had joined the Government Service as P.G.Teacher (English) in Government Boys Higher Secondary School, Gangavalli, Salem District, following her appointment as Junior B.T.Assistant on 09.07.2004. After her promotion, she was transferred on 17.10.2015 to the Government Higher Secondary School, Pasumbalur, Perambalur District. Thereafter, she was transferred to the Government

Higher Secondary School, Googayiur, Villupuram District, on 01.06.2017. Once again, she was transferred to the fourth respondent School on 28.08.2017. However, her junior one D.Yuvaraj, P.G.Teacher (Commerce), who was appointed on 29.09.2005, promoted as B.T.Assistant on 01.06.2006 and thereafter, promoted as P.G.Assistant on 12.08.2017.

4. After his fixation of pay on 01.04.2018, he was drawing higher salary of Rs.68,500/-. The petitioner was drawing the salary of Rs.60,900/-. Therefore, in order to rectify the pay anomaly, the Government issued G.O.Ms.No.303 Finance (Pay Cell) Department, dated 11.10.2017. Accordingly, the petitioner submitted a representation and after receipt of the same, the fourth respondent had submitted a proposal to the third respondent as per norms. However, it was returned by the third respondent on 20.10.2023. Once again, the said proposal was forwarded to the third respondent.

5. Without expressing any opinion on the merits of the writ petition, the third respondent is directed to pass appropriate orders on the

proposal sent by the fourth respondent within a period of eight weeks from the date of receipt of a copy of this order.

6. With the above direction, this writ petition stands disposed of. No costs.
