..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus forbearing them from interfering with petitioner's peaceful possession and enjoyment in the land situated in Nathahalli Village and comprised in S.No.709/1A2 Dry Extent 0.20.0 Hec. in Dharmapuri Taluk and Dharmapuri District except by due process of law and grant such further reliefs.

ORDER
This writ petition is filed to forbear the respondents from interfering with
petitioner's peaceful possession and enjoyment in the land situated in Nathahalli Village and comprised in S.No.709/1A2 Dry Extent 0.20.0 Hec. in Dharmapuri Taluk and Dharmapuri District except by due process of law and grant such further reliefs.

Learned counsel for the petitioner would submit that the land comprised in S.No.709/1A2, dry extent 0.20.0 Hec, situated at Nathahalli Village, Dharmapuri Taluk and District belongs to the petitioner. However, without issuing any notice to the petitioner, the second respondent carried out inspection and measurements in the subject land for the purpose of constructing public utility building. Hence, the petitioner has come forward with this writ petition to forbear the respondents from interfering with the aforesaid subject property.
3. Learned Government Advocate appearing for the respondents would submit that the petitioner himself settled the subject property in favour of the Government in the year 1990. Therefore, the respondents have inspected the said property for constructing the public utility building.
4. Heard the learned counsel on either side and perused the materials available on record.

In view of the above, if there is any settlement deed executed by the petitioner in favour of the Government, in the year 1990, the respondents are directed to verify the same and thereafter visit the subject property and earmark the land for construction of public utility building. In the event, no such deed was executed, certainly, the respondents are directed to acquire the said land by following the due process of law and thereafter, proceed with the construction. With the aforesaid observation and direction, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
