ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections341, 294(b), 324, 506(ii) of IPC in Crime No.1484 of 2021, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that while demolished the part of Apartment's compound wall on the backside of house and tried to make gate to make an entry to the 3rd street, due to which, the petitioners assaulted the defacto complainant and her husband with deadly weapons and abused them with filthy language, threatened them with dire consequences. Hence, the complaint.

3. The learned counsel appearing for the petitioners submit that the petitioners are innocent person and they have not committed any offence as alleged by the prosecution and there was a case in counter. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Additional Public Prosecutor (Crl.Side) appearing for the respondent opposed for granting anticipatory bail to the petitioners by stating that the petitioners were assaulted the defacto complainant and her husband, during the course of demolished the Apartment's Compound wall in their house.

5. Considering the facts and circumstances of the case and also considering the submissions made by the both counsel and also the fact that the case is civil in nature, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. 6.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or their appearance, within a period of fifteen (15) days after lifting of lockdown or the commencement of the Court's normal functioning whichever is earlier, before the learned Judicial Magistrate No.2, Poonamalle, Thiruvallur on condition that the petitioners shall execute a bond for a sum of Rs.

[b] the petitioners shall report before the respondent police on Saturday at 10.30 a.m for a period of four weeks and thereafter as and when required for an interrogation;

[c] the petitioners shall not tamper with evidence or witness either during investigation or trial;

[d] the petitioners shall not abscond either during investigation or trial;

[e] on breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions has been imposed and the petitioners are released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;

[f] if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC;
