O R D E R

The petitioner was arrested and remanded to judicial custody from 27.11.2025 for the offences punishable under Sections 318(4), 351(2) & 3(5) of BNS, 2023 in Crime No.200 of 2025, seeks bail.

2. The allegation against the petitioner is that he is arrayed A5 in this case. It is the case of the prosecution that the petitioner, along with the other accused, identified lands belonging to various persons who were not residing and, in connivance with the co-accused, entered into transactions with third parties by falsely projecting themselves as the owners of the properties. It is further alleged that one such property was sold to a victim by producing fabricated documents as if they were the genuine owners of the property. By adopting such modus operandi, the petitioner is alleged to have collected a sum of Rs.1.95 lakhs from two victims in respect of the said properties. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the co-accused have already been granted bail by the learned Magistrate. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Crl.side) appearing for the respondent submitted that the total amount involved in the offence is about 25 lakhs and so far only a sum of Rs.1.95 lakhs has been traced to the petitioner. He further submitted that this is not a simple case of cheating, but involves fabrication of documents relating to immovable properties. The investigation is still pending. Hence, he opposed to grant bail to the petitioner.

5. Heard the learned counsel on either side and perused the materials available on record.

6. Considering the fact that the allegations involve not only cheating but also fabrication of documents relating to properties and the investigation is still pending, this Court is not inclined to grant anticipatory bail to the petitioner.
