This application has been filed by the Official Trustee of Tamil Nadu, seeking permission to donate a sum of Rs.4,00,000/- (Rupees Four Lakh only) to Chief Judge of Small Causes Court, Chennai for construction of new temple to "A/m.Needhi Vinayagar" at Judicial Officers' Quarters, Egmore with further permission to meet the said expenses from and out of the accumulated fund of Kadapakkam Charities that relates to 2018-2019.

2. Learned Administrator General and Official Trustee (AG & OT) has submitted that the Trust Estate of Kadapakkam Charities is under the interim control of the office of AG&OT as per the scheme decree dated 22.11.1934 in A.No.1780 of 1963 in C.S.No.200 of 1930 dated 11.10.1963 (Ex.D1). It is further submitted that the Chief Judge of Small Cause Courts, Chennai had submitted a written request for construction of a new Needhi Vinayagar Temple in the place of existing one, situated in the Judicial Officers' Quarters at Egmore, Chennai for about 20 years, as the said Temple got damaged on account of the recent flood. Hence, permission is sought for donation of Rs.4,00,000/- to the Chief Judge of Small Cause Courts, Chennai. S.VAIDYANATHAN,J.

It is seen from the report of the AG&OT that as the Temple is 20 years old and the torrential rain during Cyclone Michaung heavily inundated even Vinayagar, this Court is of the view that there is an immediate requirement for construction of the Temple, so as to prevent it from further deterioration. Therefore, permission is granted to the AG&OT to donate a sum of Rs.4,00,000/- (Rupees Four Lakh only) to the Chief Judge of Small Causes Court, Chennai for construction of a new temple to Needhi Vinayagar at Judicial Officers' Quarters, Egmore, Chennai, as per the following schedule:

i) Rs.3,00,000/- (Rupees Three Lakhs only) shall be released on commencement of the construction work;

ii) The remaining portion Rs.1,00,000/- (Rupees One Lakh only) shall be disbursed during consecration.
