The petitioners apprehend arrest at the hands of the respondent police for the alleged offences under Sections 419, 420, 468, 471, 120(B) and 506(i) IPC., and seek anticipatory bail.

2. The case of the prosecution is that the petitioner in Crl.O.P.No.10917 of 2015, married the defacto complainant, 32 years ago and they were blessed with two daughters and a son. The Defacto complainant had purchased an extent of 6980 Sq.Ft., comprised in Old T.S.No.141/1, New T.S.No.21/1 in Ward D Block 4 of Vaniyampati Municipal Town, under a sale deed, dated 10.05.1989, from the parents of the petitioner in Crl.O.P.No.10917 of 2015.

The further case of the prosecution is that the petitioner in Crl.O.P.No.10917 of 2015 has executed a sale deed, dated 12.04.2006, in favour of her son, viz., petitioner in Crl.O.P.No.10918 of 2015, by referring an oral gift (HEBA), dated 25.05.2012, executed by the defacto complainant in favour of the petitioner in Crl.O.P.No.10917 of 2015. Hence, a complaint was lodged before the learned Judicial Magistrate, Vaniyampadi, who forwarded the complaint, under Section 156(3) Cr.P.C., to the respondent-Police, for investigation.

Considering the facts and circumstances of the case, this Court is inclined to grant the relief of anticipatory bail to the petitioners, but imposing stringent conditions.

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Magistrate concerned within a period of 15 days from the date of receipt of a copy of this order, on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned District Munsif cum Judicial Magistrate, Vaniyambadi, or to the satisfaction of the respondent police or the police officer who intends to arrest and on further condition that the petitioners shall appear before the learned District Munsif cum Judicial Magistrate, Vaniyambadi, daily at 10.30 a.m., within a period of two weeks and thereafter, as and when required. 30.04.2015 skm CRL.
