This petition has been filed to condone the delay of 290 days in filing the Second Appeal.

2. Though notice has been served on the respondent and his name has been printed in the cause list, there is no representation for the second respondent.

3. Mr.S.John Peter, learned Counsel entered appearance for the first respondent and expressed his objection for condoning the delay.

4. However, the reasons adduced in the affidavit filed in support of this petition being satisfactory, this petition is ordered and thereby, the delay of 290 days in filing the second appeal is condoned.
