PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, prayed to direct the first respondent to issue direction to the second respondent to take action against the third respondent and to give protection to the petitioner on the complaint dated 20.11.2017 according to law immediately. ORDER

This petition has been filed to direct the second respondent to take action against the third respondent and to give police protection to the petitioner on the complaint dated 20.11.2017.

2. The learned counsel for the petitioner has submitted that the Village Panchayat gave consent for constructing a https://hcservices.ecourts.gov.in/hcservices/

house, but the third respondent has unlawfully trespassed into the property of the petitioner and demanded rowdy mamool of Rs.10,000/- and hence the petitioner has lodged a complaint before the second respondent on 20.11.1017, but, so far, no action has been taken.

3.The learned Additional Public Prosecutor who is appearing for the respondents 1 and 2 has submitted that after receipt of the complaint, CSR.No.320 of 2017 has been issued and enquiry has been conducted and during enquiry, the petitioner has stated that he has compromised with the third respondent and accordingly, the said complaint was closed on 12.02.2018. 4.Recording to the aforesaid submission, this petition is dismissed as infructuous. If any problem is created by the third respondent in future, it is open to the petitioner to give a fresh complaint.
