PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, to call for the entire case particulars in Crime No.897 of 2014 pending on the file of the respondent police and to order transfer of investigation, thereby to order withdrawal of the case from the file of the respondent police and entrust the case with an independent agency like CBI, and to further direct them to carry out impartial investigation and to final report within a stipulated period.

O R D E R

This Criminal Original Petition has been filed to call for the entire case particulars in Crime No.897 of 2014 pending on the file of the respondent police and to order transfer of investigation, thereby to order withdrawal of the case from the file of the respondent police and entrust the case with an independent agency like CBI, and to further direct them to carry out impartial investigation and to final report within a stipulated period.

2. It is seen that the investigation in Crime No.897 of 2014 is pending on the file of the respondent police. Now, almost five years have been lapsed and hence, due to the lapse of period, the prayer sought for by the petitioner cannot be granted now.

3. However, considering that the crime is of the year 2014, the respondent police is directed to complete the investigation in Crime No.897 of 2014 and file a final report within a period of four weeks from the date of receipt of a copy of this order, if not already filed.

4. Accordingly, this Criminal Original Petition is dismissed.
