Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, calling for the records and to quash the impugned circular dated 05.01.2024 (Ref.No.000033/E3/1/2024) issued by the second respondent and consequently direct the respondents to act as per G.O.(2D)No.131 dated 20.11.2007 and to determine the qualification for any Medical Officer to

ORDER
This Writ Petition has been filed for the issuance of Writ of Certiorarified Mandamus, calling for the records and to quash the impugned circular dated 05.01.2024 (Ref.No.000033/E3/1/2024) issued by the second respondent and consequently direct the respondents to act as per G.O.(2D)No.131 dated 20.11.2007 and to determine the qualification for any Medical Officer to receive promotion in a service as for station seniority and not by their departmental seniority in accordance with law.
2. The learned counsel for the petitioner would submit that on instructions, the petitioner approached the second respondent and the second respondent had given assurance that they will follow G.O.(2D)No.131 dated 20.11.2007. Therefore, he seeks permission of this Court to withdraw this petition.
3. In view of the above submission and endorsement made by the learned counsel for the petitioner, this writ petition is dismissed as withdrawn. Consequently, connected Miscellaneous petition is closed. No costs.
