This Transfer Civil Miscellaneous Petition is filed to withdraw HMOP.No.267/2012 on the file of Family Court, Nagercoil and transfer the same to any other Court at Chennai.
2. From the records it is seen that the petitioner/wife has already filed an application in HMOP.No.3726/2018 on the file of learned V Additional Family Court, Chennai. As a counter to that petition, the respondent filed a petition for restitution of conjugal rights before Nagercoil Court. It is also seen that both the petitioner and respondent are employed in Chennai. Even, in the petition filed by the husband for restitution of conjugal rights, it is clearly stated that originally the petitioner was working as Systems Engineer in TCS, Bangalore and transferred to Chennai and respondent was working as Credit Manager in H.D.F.C.Bank, Chennai.
3. Considering the convenience of the parties, who are presently working at Chennai, this Court is inclined to transfer the petition for restitution of conjugal rights in HMOP.No.267/2003 pending on the file of Family Court, Nagercoil to the file of Family Court, Chennai.
4. Accordingly, HMOP.No.267/2018 is withdrawn from the file of Family Court, Nagercoil and the same is transferred to the file of Family Court, Chennai. The Principal Judge Family Court, Chennai is directed to renumber the petition and allot to appropriate Court.
5. The Transfer Civil Miscellaneous Petition is disposed of with the above directions. No costs. Consequently, connected miscellaneous petition is closed.
