ORDER

The petitioners, who apprehend arrest for the alleged offence under Sections 303, 326(a) of BNS of 2023 in Cr.No.461 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioners joining hands with other accused involved in quarrying the sand from the Thenpannai river and at the time of intervention of officials, they found that each carrying 1⁄2 unit in their bullock cart. Hence, case has been registered.

3. The learned counsel appearing for the petitioner submitted that the petitioners have not committed any such offence as alleged by the prosecution and they are ready to co-operate with the investigation. Hence, he prayed for the grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side), appearing for the respondent police, reiterated the prosecution case and submitted that except the second petitioner, other petitioners have no previous cases and the investigation is pending in this case. Hence, he vehemently opposed the grant of anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record. 2/4

6. Considering the fact that the petitioners have jointly colluded and entered into the river and taken away the sand and thereby damaged the river bed and also caused damage to the ecology. If the petitioners are enlarged on bail, they will indulge in similar offences. Hence, I am not inclined to grant anticipatory bail to the petitioners.

7. Accordingly, this Criminal Original Petition is dismissed. 29.01.2026 Vv To
