Room #576 Hotel Samrat, Chanakyapuri, New Delhi 110 021 Represented by its authorised representative ..Plaintiff -vs- *V.D.Chidambaranar Port Trust, Tuticorin 628 004 Represented by its Chairman (Amended as per order dated 24.10.2016 in A.NO.5051/2016) ...Defendant This Civil Suit prays that this Honble Court may be pleased to pass a Judgement and Decree in favour of the Plaintiff and against the Defendant directing the Defendant to:

(a) Pay to the Plaintiff the sum of Rs.17,03,92,315/- (Rupees Seventeen Crores Three lakhs Ninety Two Thousand Three Hundred and Fifteen Only) together with interest @ 15% per annum on a sum of Rs.14,13,00,000/- from the date of the plaint till the date of realization.

(b) pay costs of this suit.

This Civil Suit coming on this day before this court for hearing the court made the following order: The learned counsel for the defendant submitted that he has already forwarded the settlement proposal to the Ministry of Shipping and they are awaiting for the reply. 2.

This Court expects the Ministry of Shipping to send their approval to the defendant at the earliest, as this proposal is pending for a long time and the dispute involved herein pertains to the Commercial Dispute, the matter needs to be adjudicated at the earliest. Therefore, if earlier the approval by the Ministry of Shipping is furnished to the defendant, the matter can be heard early and disposed of. Therefore, the defendant is directed to forward a copy of this order to the Ministry of Shipping to take appropriate steps as regards the approval, for the proposal forwarded by the defendant.
