O R D E R

The transfer C.M.P. has been filed by the wife seeking transfer of H.M.O.P. No. 1232 of 2019 filed by the respondent/husband before the Family Court, Madurai, seeking divorce, on the ground of cruelty to the Family Court at Chennai. 2.

The marriage between the petitioner/wife and the respondent/husband was solemnised on 09.11.2018 at Arulmigu Meenakshi Sundareshwarar Temple, Madurai as per Hindu rites and customs. There is no issue out of the wedlock. According to the petitioner, the respondent is working as Systems Manager in Barclays Bank, Pune. As the respondent was not interested in living with the petitioner, she returned to her parental home soon after the marriage, in January, 2019 itself and since then, the petitioner has been staying with her maternal grandmother. Subsequently, the respondent had filed divorce petition in H.M.O.P. No. 1232 of 2019 before the Family Court, Madurai, seeking divorce on the ground of cruelty. The petitioner further states that her parents are aged and having age related ailments.

Therefore, it may not be possible for them to accompany her to Madurai for every hearing and it is also very difficult for her to travel from Chennai to Madurai for every hearing as she has no income of her and she is struggling even for her basic needs. In such circumstances, the petitioner filed the present transfer petition for the aforesaid relief.

During the pendency of the transfer C.M.P., as there were chances of settlement between the parties, at the request of the parties, the matter was referred to the Mediation Centre attached to this Court to facilitate an amicable settlement to the marital dispute.

Pursuant to the same, the parties have arrived at a settlement and when the matter is taken up today, a joint memo of compromise dated 26.06.2021, duly signed by both the parties and countersigned by their respective counsel has been filed before this Court. The joint memo of compromise shall form part of the records.

In view of the joint memo of compromise dated 26.06.2021, the transfer C.M.P. stands closed. No costs. Connected C.M.P. is closed.
