Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the second respondent to forward the petitioner name in response to the letter of the first respondent made in No.012575/155/G.29/ G.292/2012-6 dated .03.2013 signed on 15.03.2013 for preparation of panel for promotion to the post of Accounts Supervisor as represented by the petitioner in his representation dated 25.03.2013.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the second respondent to forward the petitioner's name in response to the letter of the first respondent made in No.012575/155/G.29/G.292/2012-6 dated .03.2013 signed on 15.03.2013 for preparation of panel for promotion to the post of Accounts Supervisor as represented by the petitioner in his representation dated 25.03.2013.

2.The case of the petitioner is that the petitioner entered the services of the Board as Junior Assistant on 18.11.1993 and was promoted as Assistant (Accounts) on 01.03.1996 and the next avenue of promotion is to the post of Accounts Supervisor. 3.It is the further case of the petitioner that the first respondent vide letter dated 15.03.2013, requested the Superintending Engineer to call for particulars of those who have been qualified for promotion to the post of Accounts Supervisor fixing the crucial date as 20.03.2012. Since the preparation of report for finalization of panel was under process, the petitioner submitted his representation dated 25.03.2013 requesting the first respondent to call for the reports among the Assistants who are qualified as on 20.03.2013. According to the petitioner, he is fully eligible to be considered for promotion, however, his representation was not considered. Hence, this writ petition.

4.The learned counsel appearing for the petitioner would submit that without going into the merits of the case, it would suffice if this Court issues direction to the second respondent to forward the name of the petitioner in response to the letter of the first respondent made in No.012575/155/G.29/G.292/2012-6 signed on 15.03.2013 for preparation of panel for promotion to the post of Accounts Supervisor, in accordance with law. 5.The learned Standing Counsel appearing for the respondents has no serious objection for this Court issuing such a direction. 6.In view of the above, this Court, without going into the merits of the case, directs the second respondent to forward the name of the petitioner in response to the letter of the first respondent made in No.012575/155/G.29/G.292/2012-6 signed on 15.03.

2013 for preparation of panel for promotion to the post of Accounts Supervisor, in accordance with law, within a period of three months from the date of receipt of a copy of this order. 7.The writ petition is accordingly disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
