ORDER
The present writ petition has been filed praying for a writ of mandamus to direct the respondents 3 to 5 to consider the representations dated 10.06.2024 and 03.07.2024 for correction of the classification of the land comprised in S.Nos.117, 174, 130/7, 130/8, 130/10 and 184 at Sembarambakkam Village, Poonamallee Taluk, Tiruvallur District.
2. It is submitted by the learned counsel for petitioner that this is the
second round of litigation. Earlier, petitioner filed a writ petition in W.P.No.11142 of 2017 to direct the respondents to consider the petitioner's representations for the issuance of computerized patta in respect of the land comprised in S.Nos.117, 174, 130/7, 130/8, 130/10 and 184. This Court by order dated 28.04.2017 disposed of the above writ petition directing the respondents to consider the representation on merits. Pursuant thereto, the 5 th respondent vide his communication dated 26.12.2023, stated that the petitioner's request for issuance of patta cannot be considered insofar as the property comprised in S.No.117 and 130/8 are Poromboke Odai and Poromboke Kuttai. For reference, the classification of the subject lands referred by the petitioner is classified as follows:

It is submitted by the learned Additional Government Pleader appearing on behalf of the respondents that petitioner thereafter submitted a representation dated 03.07.2024 to the District Collector, who is stated to be the appropriate authority for rectification of any error in survey of the land. Pursuant to the above representation, the District Collector / 3 rd respondent herein, directed the Revenue Divisional Officer, Tiruvallur by proceedings dated 03.07.2024, to conduct an inquiry and forward a report and consider the said representation. However, the learned Additional Government Pleader would fairly submit that the petitioner's representation will be considered and appropriate orders would be passed within a time frame fixed by this Court, which was agreed to by the learned counsel for petitioner.

In view of the same, taking into consideration the facts and circumstances and the limited relief sought for in this Writ Petition, there shall be a direction to the respondents to consider the petitioner's representations dated 10.06.2024 and 03.07.2024, on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the
petitioner and any other interested persons/stake holders, including rival claimants, if any, within a period of 16 weeks from the date of uploading of the web copy without waiting for the receipt of certified copy. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law.
