Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Direction directing the respondent 2 and Respondent 3 to expedite and take over the physical possession of these 200 Properties (Unsold-re-possessed Flats) appearing in the web site of IOB for auction sale including that of the Flat Mortgaged by the respondent 5 within 15 days under S. 13(8) r. w. S. 14 of SARFAESI Act so that these vacant Flats are handed over to the respective Prospective buyers along with the Issuance of sale Certificate and other reliefs.

ORDER

(made by SENTHILKUMAR RAMAMOORTHY, J.) The petitioner complains about the alleged irregularities by the Indian Overseas Bank in relation to loans extended to third parties.

2. The writ petitioner admits that he is neither a borrower nor guarantor. He is also not a creditor, lessee, auction purchaser or any other person aggrieved in respect of the loans or the secured assets. He asserts that he is a neighbour of some of the respondent - borrowers. As such, he does not have the locus standi to maintain this writ petition, which is not filed as a public interest litigation.

3. Consequently, W.P.No.4724 of 2021 is dismissed. Such dismissal shall not prejudice the rights of any person aggrieved to challenge the proceedings relating to the loan accounts or the sale of secured assets in accordance with law. There will be no order as to costs.
