ORDER
This petition has been filed by A1, S.Srinivasan, to call for records in C.C.No.261 of 2016 now pending on the file of the VIII Metropolitan Magistrate Court, Chennai.
2.It is seen that the said petitioner, had been absconding from appearance before the connected matters which are pending in various other Court for practically same offence as stated in the status report which has been filed by the prosecution, wherein they had stated that the present petitioner had not appeared before the trial Court and that petitions under Section 317 Cr.P.C has been filed. It is also seen that as against A2 and A3 non-bailable warrants are pending.
3.This would only be a mockery of proceedings if the Court where to accept the petition of a particular accused and at the same time encourage other accused to abstain from Court proceedings, when non-bailable warrants are pending against https://hcservices.ecourts.gov.in/hcservices/
other accused. Let all the three accused appear before the trial Court and let the learned Magistrate take a considered decision. 4.With the above observations, the present Criminal Original Petition is dismissed.
