ORDER

The petitioner, who was arrested and remanded to judicial custody on 09.12.2025 for the offences punishable under sections 379 of IPC in Crime No.279 of 2022 in C.C.No.148 of 2022 on the file of the learned Judicial Magistrate, Paramathy, seeks bail.

2. The petitioner was earlier arrested and released on bail. Subsequently, he jumped bail on 05.06.2025, and the Non Bailable Warrant was executed on 09.12.2025. Hence, the case.

3. The learned counsel for the petitioner submitted that due to sudden ill health of the petitioner's relative, he was not able to appear, and he was looking after his family members. He further submitted that now the Non Bailable Warrant was executed, and is ready to abide by any condition imposed by this court. Hence prayed for grant of bail.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the Non Bailable Warrant was pending for six months, and due to his abscondance the trial was stalled. Hence, he opposed to grant bail to the petitioner.

5. Considering the fact that the petitioner absconded for nearly six months and is also hailing from a neighbouring state, and if the petitioner is released on bail there is likelihood that he will abscond again, and the trial is already pending for long time, I am not inclined to grant bail to the petitioner.
