Criminal Original Petition filed to direct the second respondent to register the complaint dated 02.08.2013 lodged by the petitioner before the second respondent police.

2.When the matter is taken up for hearing on 13.06.2019, there was no representation for the petitioner and was posted under the caption "for dismissal" on 14.06.2019. Even today, there is no representation on behalf of the petitioner. 3.The learned Government Advocate [Crl. Side] submits that the petitioner is the house owner of the apartment namely "Lakshmi Apartment", No.14/22, Athreyapuram Main Road, Choolaimedu, Chennai - 94. Due to the sudden financial commitment he let his flat to one G.Venkateshwara Moorthy, who is an advocate by profession. There seems to be some dispute between the petitioner and the tenant. The above said G.Venkateswara Moorthy neither paid the rent nor let him into his property. Hence, the petitioner lodged a complaint before the first respondent. Thereafter, both the petitioner and the said G.

Venkateshwara Moorthy had been summoned by the second respondent and the said G.Venkateshwara Moorthy had given an undertaking that he would vacate the premises, within a period of one year. It is now submitted that the portion has been vacated by the said G.Venkateshwara Moorthy and the same has been handedover to the petitioner. In view of the same nothing survives for adjudication in this matter. Hence, this Court feels that this Criminal Original Petition is to be dismissed. 4.At this juncture, the learned counsel appearing for the petitioner seeks permission of this Court to withdraw this petition and he also made an endorsement to that effect. 5.In view of the submissions and endorsement so made, this Criminal Original Petitions stands dismissed as withdrawn.
