S.R. Mahendran v. T. Thomas Educational Trust

2015-03-31Honourable Mr Justice P.R.Shivakumar,Honourable Mr Justice V. Ramasubramanian1 pages

CMP.No.12 of 2015 in O.S.A.No.49 of 1995 VRSJ & PRSJ We passed an order holding that any application for modification of the scheme should go only before the Single Judge. But in the last portion, it is wrongly indicated that the Registry should post the miscellaneous petition before the Single Judge.

Since the miscellaneous petition is filed in OSA, the petitioner should take up an independent petition. This petition cannot go before the Single Judge. Therefore, with liberty to the petitioner to go before the Single Judge this miscellaneous petition is dismissed.

As a matter of fact, the petition to accept cause title is not at all necessary in such cases, in view of the fact that the main application is for modification of a scheme decree.
