The relief sought for in the present writ petition is to the 1st to 5th respondents to Consider Representation dated 29/07/2024 and 16/12/2025 for Removal of the encroachment by the 6th and 7th Respondent of public Pathway (Pothupathai Pattai) i.e.Government Poramboke land it category of Pattai bearing survey No.79 of Tattacheri Village, Kalavai Taluk, Ranipet District.
2. Learned counsel for the Panchayat Union, Thimiri would submit that
inspection and survey was conducted by the Block Development Officer/Executive authority. The encroachers are identified and the authorities have already issued show cause notice to the encroachers. The encroachers are afforded with an opportunity to submit their explanations along with the documents, if any. If the encroachers fail to vacate the encroached portion of the panchayat property, then the Block Development Officer/Executive authority has to submit a report to the jurisdictional Tahsildar, who in turn, is bound to initiate eviction proceedings by following the procedures as contemplated under the TamilNadu Land Encroachments Act, 1905. Learned counsel for the petitioner would submit that the encroachers are identified on the streets.

In view of the above factual position, the official respondents are directed to initiate all appropriate action in the manner known to law within a period of twelve weeks from the date of receipt of a copy of this order.
