JUDGMENT

(Delivered by the Hon'ble Acting Chief Justice) This appeal is directed against the interim order dated 23.12.2022 made in WMP No.33869 of 2022 in W.P.No.34406 of 2022.

2. When the matter is taken up for hearing, learned counsel appearing for both the parties submitted that the writ petition would be taken up today at 4 pm by the learned Single Judge and that they

would argue the matter.

3. Learned counsel for the appellant submitted that in view of the filing of this appeal, the counter could not be filed before the learned Single Judge, though it was made ready and therefore, requested this Court to permit him to file the same before the learned Single Judge.

4. In view of the above, the writ appeal is dismissed. The appellant is at liberty to file the counter before the learned Single Judge. There will be no order as to costs. Consequently, CMP No.1376 of 2023 is also dismissed.
