A.No.3343 of 2024 has been filed by the applicant to re-open the plaintiff side evidence for examination of a further witness in this suit at this stage of the suit. A.No.3344 of 2024 has been filed by the applicant to issue a court Summons, Sub-poena directing E.D.Thamarai Selvan, The Deputy Director, Document Division, Forensic Sciences Department, 30-A, Kamarajar Salai, Mylapore, Chennai 600 004, to appear before this court on a specified date for recording his chief/cross examination as a witness in the above suit.

2. The learned counsel for the respondent submitted that these applications are filed in the belated stage and filed the exhibit in the year 2022. At this stage, these applications cannot be allowed. He vehemently opposed to allow these applications.

3. Having satisfied with the reasons stated in the affidavit filed in support of these applications, this Court is inclined to allow these applications by imposing cost.

4. Accordingly, these two applications are allowed on condition that the applicant pays a sum of Rs.1000/- (Rupees One Thousand only) on A.No.3343 of 2024 and Rs.1000/- (Rupees One Thousand only) on A.No.3344 of 2024 to the https://www.mhc.tn.gov.in/judis

gv respondents on or before 13.08.2024. In the event of failure on the part of the applicant in paying the said amount within the stipulated time, these applications shall stand dismissed automatically without any further reference to this Court.

5. Registry is directed issue Sub-poena directing E.D.Thamarai Selvan, The Deputy Director, Document Division, Forensic Sciences Department, 30-A, Kamarajar Salai, Mylapore, Chennai 600 004, to appear before this court on 13.08.2024 for recording his chief/cross examination as a witness in the above suit.

6. Post these matters on 13.08.2024.
