C.M.P.No. 10768 of 2020 in C.R.P. SR. No. 93344 of 2019 T.V. THAMILSELVI, J.

This petition has been filed seeking to condone the delay of 2 days in filing the above Revision against the order dated 08.04.2019 in I.A.No.163 of 2017 in A.S.No.1 of 2005 on the file of learned Sub-Judge, Dharapuram.

2. Mr.N.Ponraj, learned counsel for petitioner submitted that the copy of order was made ready on 23.04.2019 and it was delivered on 24.04.2019. After receipt of the order copy, the petitioner was advised to prefer revision within 90 days. However, due to his ill-health, the petitioner was not able to mobilise the fund to meet the expenses in filing the revision. Thereafter, after arranging money, he contacted his counsel and requested to file the above C.R.P. However, there is a delay of 2 days arose in filing the above C.R.P. and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one. Accordingly, this court is inclined to allow this petition and Registry is directed to number the Civil Revision Petition if it is otherwise found to be in order and post the matter for admission on 23.03.2023.
