ORDER
(Order of the Court was made by C.V.Karthikeyan J.) The third respondent, viz., District Educational Officer has filed an affidavit dated 04.02.2026.
2. We would extract paragraphs 5, 7 and 8 of the aforesaid affidavit :- "
5.It is submitted that one P.Ratika was appointed as B.T.Assistant on 01.06.2012 and her appointment was approved by the Chief Educational Officer, Chennai vide proceedings Na.Ka.No. 9401/Aa2/2021, dated 25.02.2025. Further, it is submitted that one-month salary i.e., June, 2012 was disbursed to P.Ratika on 21.01.2026 through ECS. It is also submitted that the balance salary will be disbursed to P.Ratika within three weeks without any delay.
7.It is also submitted that the Management of the School i.e., Contempt Petitioner has not submitted the bills from February, 2014 to till date. The Pay and Accounts Officer, Chennai-North has instructed to submit the bill for each month. Month wise bill will be submitted to the Pay and Accounts Officer as and when the bill received from the Contempt Petitioner. 8.It is submitted that one another person in this case,
Tmt.A.Jeyanthi Mala was also appointed as B.T.Assistant on 04.10.2012 and appointment was also approved by the Chief Educational Officer, Chennai vide Na.Ka. No. 9402/A2/2021, dated 25.02.2025. In the means while she expired on 13.12.2021. With regard to salary, her husband Thiru C.M.Murali has claimed her benefits as a legal heir. Detailed death certificate and legal certificate and all proposals have been received with Service Register from the contempt petitioner on 02.02.2006. But, month wise bills has not been submitted by the Contempt Petitioner in respect of Tmt.Jeyanthi Mala. As and when the bills was received from the Contempt Petitioner, after verifying the proposal and the bills submitted by the Contempt Petitioner, (school management) the salary benefits will be submitted to the Pay and Accounts Officer for payment."
3. Recording the same, this contempt petition stands closed.
4. The learned counsel for the petitioner states that on the death of Tmt.Jeyanthi Mala, the petitioner had been appointed a Teacher and the said Teacher is fully qualified.
