This petition has been filed to modify the condition imposed on the petitioner in para no.8(b) in Crl.O.P.No.24999 of 2022 on 16.11.2022.

2. The learned counsel for the petitioner submitted that while granting anticipatory bail to the petitioner, this Court directed the petitioner to deposit a sum of Rs.1,15,000/- (Rupees One Lakh Fifteen Thousand only) to the credit of Crime No.445 of 2022, before the concerned Magistrate, within a period of eight weeks from today and the balance amount of Rs.1,00,000/- (Rupees One Lakh only) to the credit of Crime No.445 of 2022, before the concerned Magistrate, within a period of eight weeks thereafter". However, he is unable to mobilize the funds to deposit the amount within the stipulated time. Hence, the modification petition has been filed by the petitioner.

Considering the facts and circumstances of the case, reason is justifiable, hence, this Court modifies the condition that the petitioner shall deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) to the credit of Crime No.445 of 2022 before the concerned Magistrate, within a period of eight weeks from the date of receipt of copy of this order and further two weeks time is extended to the petitioner to surrender and execute the sureties. The other conditions imposed by the Court shall remain intact.
