O R D E R

(The case has been heard through video conference) The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 4(1)(aaa) r/w.4(1-A) of TN Prohibition Act in Crime No.1181 of 2020, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is said to have found in possession of 110 liters of arrack without license. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not indulged any offence as alleged by the prosecution. He further submitted that a case has been foisted against the petitioner. Hence, he prays for anticipatory bail to the petitioner.

State submitted that the petitioner is a history sheeter and that he was involved in six previous cases. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

5. Considering the nature of the offence committed by the petitioner and taking note of the submission that the petitioner is a habitual offender and that there are six previous cases pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
