This Miscellaneous Petition has been filed seeking to cancel the anticipatory bail granted in Crime No.173 of 2023 registered by the 1st respondent under Sections 448, 323, 294(b), 354, 506(ii) I.P.C r/w 34 I.P.C in Crl. O.P. No.25344 of 2023 by order dated 06.11.2023 for the 2nd - 8th respondents.

It is the grievance of the de-facto complainant who has filed the present petition that the respondents 2 - 8, after obtaining anticipatory bail, had once again indulged in assaulting the petitioner on 21.12.2023 at about 4.30 p.m. at E.C.R. road. In this connection, further FIR in Crime No.235 of 2023 had been registered under Sections 294(b), 323, 324, 506(ii) r/w 34 of I.P.C.

Learned Public Prosecutor for the State Union Territory of Puducherry stated that with respect to one of the cases, a charge sheet has been filed. There seems to be a continuous allegation of assault by the 1/3
petitioner as against the accused and accused as against the petitioner herein. Instead of cancelling the bail, let me make the conditions which had been imposed earlier a little more stringent and it is directed that the respondents 2 - 8 herein who had obtained anticipatory bail in Crime No.173 of 2023 by order dated 06.11.2023 in Crl. O.P. No.27344 of 2023 shall appear before the 1st respondent Police everyday morning at 10.30 a.m. and evening at 5.30 p.m. They must commence with the compliance of this condition from the next day of receipt of a copy of this order and that condition should continue until further orders.

The Criminal Miscellaneous Petition stands disposed of with the above observation.
