ORDER : The Court Made the following order :- The petitioner(A2) apprehending arrest at the hands of the respondent police for the alleged offence under Sections 4(1)(aaa) r/w 4(1-A) of Tamil Nadu Prohibition Act, in Crime No.1206 of 2019 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 15.12.2019, when the respondent police were in patrol duty they found A3 was in possession of 110 liters of Arrack without licence and the petitioner/A2 was helping A3 in selling Arrack. Hence, the respondent police registered a case against the petitioner.

3. The learned counsel appearing for the petitioner submitted that the petitioner did not indulged in any offence and hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner along A3 was in possession of 110 liters of Arrack and on enquiry the respondent police came to know that they were also selling Arrack. He further submitted that the petitioner is a habitual offender and there are two previous cases pending against the petitioner. 5. Considering the fact that the petitioner was involved in serious offences and the petitioner is a habitual offender, this Court is not inclined to grant anticipatory bail to the petitioner.
