T.V.THAMILSELVI, J.

The petitioner, who was arrested and remanded to judicial custody on 01.12.2022 for the alleged offence under Section 174(3) of Cr.P.C @ 306 of IPC in Crime No.296 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner and the daughter of the defacto complainant are husband and wife. On the date of occurrence, the defacto complainant and her son visited the petitioner's house for seeing her daughter. At that time, the petitioner brought food for her from a hotel, for which, the petitioner's mother scolded them for why bringing food from hotel for which, the victim girl committed suicide by way of hanging. Hence the complaint.

3. The learned counsel appearing for petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that there was an ulterior motive, a false complaint has been given against the petitioner and he has nothing to do with the alleged offence. He also submitted that he is ready to abide by any

stringent condition that may be imposed by this Court and he is in judicial custody from 1.12.2022. Hence, he prayed to grant bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for respondent would submit that the petitioner brought food for the victim girl from a hotel, for which, the petitioner's mother scolded them for why bringing food from hotel for which, the victim girl committed suicide by way of hanging. He further submitted that the RDO enquiry report is not yet obtained and the investigation is still pending. Hence, he opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and the gravity of the offence committed by the petitioner and the RDO enquiry report is not yet obtained, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 20.01.2023 vkr
