It is seen from the records that when the matter was taken up on 10.08.2023, the respondent filed a Status Report stating that there is no encroachment in the area of canal. Since the learned counsel for the petitioner stated that no notice has been issued to the petitioner before inspection, this Court directed the contemnors to once again conduct inspection after issuing notice to the petitioner.

2. When the matter was called on 24.08.2023, it was stated that notices were issued to the petitioner and other parties and it was realised by the parties that no encroachments and other obstacles for the flow of water were found during the inspection. Recording the said Status Report, the contempt petition was closed.

3. Today when the matter is called, learned counsel for the petitioner states that he was not present in the earlier round of litigation while closing the contempt petition. Further no notice was issued to the petitioner as stated in the earlier order, dated 24.08.2023 and a false affidavit has been filed before this Court.

4. The learned Special Government Pleader appearing for the respondent contemnor seeks short accommodation to get instructions.

Post the matter on 22.04.2024.
