ORDER

This writ petition has been filed seeking for a direction to the first respondent to defer the proposed survey of the property morefully described in the prayer to this writ petition.

2. This Court, by its order dated 10.01.2025 passed in W.P.No.664 of 2025, directed the official respondents to conduct survey and demarcation of the boundaries of the subject property.

3. The petitioner claims to be the neighbouring land owner. The petitioner claims that he has to be heard before the official respondents proceed to conduct survey and demarcation of the boundaries of the subject property. The interest of the petitioner has also been protected by the order dated 10.01.2025 passed in W.P.No.664 of 2025 filed by one K.Anbazhagan, and in the said order, this Court had directed the official respondents to issue notice to the adjacent land owners and other interested parties, and thereafter pass final orders either effecting subdivision and issuing a separate patta or rejecting the request.

Since the petitioner claims that he has not been put on notice about the survey and demarcation of the boundaries of the subject property, this Court is of the considered view that no prejudice will be caused to the respondents if the petitioner is heard and his objections are taken note of before survey and demarcation of the boundaries of the subject property is carried out. Accordingly, this writ petition is disposed of by directing the official respondents to issue notice to the petitioner and hear his objections with regard to the proposed survey to be conducted pursuant to the directions issued by this Court in W.P.No.664 of 2025, dated 10.01.2025, and only after giving due consideration to the same, the official respondents shall proceed to survey and demarcation of the boundaries of the subject property as directed by this Court in W.P.No.664 of 2025, dated 10.01.2025.
