O R D E R

(The case has been heard through video conference) The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 392 IPC in Crime No.62 of 2020, seeks anticipatory bail.

2. The case of the prosecution is that there are totally three accused involved in this case and the petitioner is ranked as A3. The allegation is that the petitioner along with others said to have waylaid the defacto complainant and snatched cell phone from him. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not indulged any offence as alleged by the prosecution. He further submitted that only for statistical purpose, a case has been foisted against the petitioner. He would further submit that the main accused were arrested and released on bail. Hence, he prays for anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the State submitted that the petitioner along with two other persons said to have waylaid he defacto complainant and snatched the cell phone from him. He further submitted that there is one previous case pending against the petitioner. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

5. Considering the nature of the offence committed by the petitioner and taking note of the submission that the petitioner is having one previous case, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
