C.M.P.No.1173 of 2016 in A.S.SR.No.10914 of 2014 S.M.SUBRAMANIAM,J In view of the endorsement made by the learned counsel appearing on behalf of the appellant that no relief sought for against the second respondent in the appeal suit, this Court is inclined to consider the miscellaneous petition.

2. In view of the reasons stated in the accompanying affidavit filed in support of this miscellaneous petition, the delay stands condoned and this petition is ordered on condition to pay a sum of Rs.500/-(Rupees Five Hundred only) to the High Court Legal Services Authority, on or before 24.01.2020, failing which, this petition would stand dismissed automatically.
