ORDER

By consent, this writ petition is taken up for final disposal at the admission stage itself.

2. This writ petition is filed for issuance of writ of mandamus directing the respondent to forthwith consider and pass orders on merits on the petitioner's application dated 29.12.2008.

3. The case of the petitioner is that he is a mini bus operator having two mini buses bearing Registration Nos. TN22/Y-7031 and TN-31/A-2235 and he was operating from Anangoor Railway Gate Pririvu to Tiruchengode bus stand. Since there is a possibility of breaking down of the minibuses and stoppage of vehicles at the time of renewal of fitness certificate, the petitioner applied for spare bus permit on 29.12.2008. Since the application is not disposed of, he sent representations on 13.7.2009, 21.03.2011, 18.4.2012 and 19.7.2016. Since no action was taken, the present writ petition has been filed. https://hcservices.ecourts.gov.in/hcservices/

4. Mrs. Radha Gopalan, the learned counsel for the petitioner would submit that it would be suffice, if a direction is given to the respondent to dispose of the petitioner's representation dated 29.12.2008.

5. Per contra, the learned Government Advocate appearing for the respondent would submit that if four weeks time is granted, the respondent shall dispose of the petitioner's representation.

6. This Court, taking into consideration the submissions made by the learned counsel for either side and without going into the merits of the case, directs the respondent to consider and dispose of the petitioner's representation 29.12.2008, on merits and in accordance with law and pass orders, within a period of four weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.

7. With the above direction, this writ petition is disposed of. No costs.
