ORDER

This petition has been filed to modify the order dated 03.02.2017 in Crl.M.P.No.891 of 2017 on the file of Court of Sessions, Villupuram Session Division, Villupuram.

2. The petitioner was directed to be released on bail by an order dated 03.02.2017 in Crl.M.P.No. No.891 of 2017, whereby the learned Principal Sessions Judge, (FAC), Villupuram had directed the petitioner to deposit a sum of Rs.5,00,000/- as a precondition for grant of bail. The petitioner has now expressed his inability to deposit the sum of Rs.5,00,000/-. The learned counsel further submitted that the co-accused in this case, by an order dated 20.01.2017 in C.M.P.No.54 of 2017 passed by the Judicial Magistrate, Gingee, was directed to be released on bail, on condition of depositing only a sum of Rs.1,50,000/- to the credit of Cr.No.44 of 2016. Hence, the petitioner has sought for modification of the condition to deposit a sum of Rs.5,00,000/-.

3. In view of the order passed by the trial Court directing the co-accused to deposit a sum of Rs.1,50,000/- as a precondition for the grant of bail, the petitioner would also be entitled for the same precondition.

4. Accordingly, the order dated 03.02.2017 passed in Crl.M.P.No.891 of 2017 on the file of the Principal Sessions Court, Vilupuram, is modified to the effect that the petitioner shall deposit a sum of Rs.1,50,000/- instead of Rs.5,00,000/-. It is made clear that all the other conditions imposed in the bail order dated 03.02.2017 in Crl.M.P.No. No.891 of 2017 on the file of Judicial Magistrate, Gingee, remain intact.

5. With the above modification, this Criminal Original Petition is disposed of.
