ORDER

Transfer Petition filed praying to withdraw and transfer the petition in H.M.O.P. No. 24 of 2023 from the file of the Family Court, Udhagamandalam, to any Family Court, Chennai.

2. The petitioner submits that she is the wife of the respondent and, due to misunderstanding, they have separated. She is living with her five years old son at Chennai, and due to her job avocation, she is residing at Chennai. She is unable to attend the Court proceedings at Nilgiris, where the divorce case filed by the husband has been pending for nearly three years. She has to travel nearly 400 km to attend the Court proceedings. Therefore, she seeks transfer of the case.

3. Notice served. None appeared.

4. The learned counsel further submits that an award of maintenance has already been passed, and the husband has also not complied with the same. However, before the Court, he expressed his desire for reunion but has not taken any steps, though the wife is ready for reunion.

5. Considering all these submissions, it also reveals that the respondent/husband is employed in a private concern. Considering the convenience of both parties, this Court is inclined to transfer the case from Udhagamandalam to the Sub Court, Alandur. After the case is taken on file, the learned Sub Judge is directed to issue notice to both parties and thereafter proceed with the matter in the manner known to law. Therefore, the Court is directed to transfer the case within four weeks from the date of receipt of a copy of this order.

6. With the above observations, this petition is allowed. No costs. Consequently, the connected miscellaneous petition is closed. 08-06-2026 Index: Yes/No Speaking/Non-speaking order MPA To
