O R D E R
The petitioner, who was arrested and remanded to Judicial custody from on 05.12.2025 for the offences punishable under Sections 318(4) @ 3(5), 318(4), 319(2), 49 of BNS Act in Crime No.182 of 2025, seeks bail.
2. The allegation against the petitioner is that on 26.11.2025 at about 6.00 a.m., when the defacto complainant was in his provision store, the accused persons came to the shop distinguishing themselves as a Sub Inspector of Police and police personnel. It is alleged that they informed the defacto complainant that several complaints had been received against his shop and demanded a sum of Rs.25,000/-. When the defacto complainant stated that he did not have such amount, the petitioner is alleged to have forcibly taken a sum of Rs.5,000/- and a 1/2 sovereign gold ring from him and thereafter escaped from the place of occurrence. Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent and person and he has been falsely implicated in this case. He further submitted that the petitioner has no previous case and that he is in judicial custody from 05.12.2025. Hence, he prays to grant bail to the petitioner.
4. The learned Government Advocate (Crl.side) appearing for the respondent submitted that there are totally four accused involved in the occurrence and the petitioner alone has been arrested so far. The other accused are still absconding and the investigation is pending. It is further submitted that the stolen property has not yet been recovered. Hence, he opposed to grant of bail to the petitioner.
5. Heard the learned counsel on either side and perused the materials available on record.
6. Considering the nature of the allegations, the fact that the co-accused are still absconding, the investigation is pending and the stolen property has not yet been recovered, this Court is not inclined to grant bail to the petitioner at this stage, as it may hamper the investigation.
7. Accordingly, this Criminal Original Petition is dismissed. 12.01.2026 kmm
