Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the third respondent to register the Settlement Deed dated 08.01.2021 and release the document in accordance with the provisions of the Registration Act, 1908.

ORDER

This Writ Petition has been filed by the petitioner seeking a direction to the third respondent to register the Settlement Deed dated 08.01.2021 and release the document in accordance with the provisions of the Registration Act, 1908.

2.Mr.T.M.Pappiah, learned Special Government Pleader takes notice for the respondents 1 to 3 and made a statement that the petitioner may produce the Settlement Deed dated 08.01.2021 along with all necessary documents from the Revenue Department, to enable the Sub Registrar to get assured himself that no fraudulent transaction takes place.

3.The said statement of the learned Special Government Pleader is recorded.

4.The petitioner is now required to produce the original Settlement Deed dated 08.01.2021 along with all necessary documents to enable the Sub Registrar, the third respondent herein to hold an enquiry within the meaning of Section 84 of the Registration Act, within one week from the date of receipt of a copy of this order.

5.Therefore, after such production by the petitioner, this Court directs the third respondent/Sub Registrar to hold an enquiry within the meaning of Section 84 of the Registration Act after issuing notice to all the parties who are likely to be affected by his decision, provide them a fair and effective hearing, and dispose of the matter through a speaking order within a period of two (2) weeks thereafter.
