ORDER
(Order of the Court was made by The Chief Justice) The present writ petition, styled as public interest litigation under Article 226 of the Constitution of India, has been filed seeking a direction to the respondents 1 to 3 to initiate immediate action to remove the encroachments made by the 4th respondent in the above said Pattai Poramboke in Survey No.28/10 at Soolankurichi Village.
2. Even though the 4th respondent is occupying the Government land, she is a landless widow and has constructed a small house over it and staying in the same house. She had already applied to the authorities seeking for Patta for the land in question. The application is still pending. The petitioner herein had already filed her objections before the authorities with regard to the grant of Patta to the 4th respondent.
3. In view of the aforesaid facts and circumstances, the 3rd respondent Tahsildar is directed to consider the application of the 4th respondent as well as the objections raised by the petitioner herein by granting the petitioner an
opportunity of hearing and thereafter pass a reasoned and speaking order, as expeditiously as possible, within a period of two months from the date of receipt of a certified copy of this order. In case the application of the 4 th respondent is rejected, the authorities shall consider removing the encroachment as well within the aforesaid period. It is made clear that we have not gone into the merits of the case.
4. The writ petition is disposed of with the above directions. There shall be no order as to costs.
