The Criminal Original Petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking a direction to complete the investigation in C.S.R.No.861 of 2024 dated 08.10.2024 and 1/4
to proceed further in accordance with law.

This Court, on 24.10.2024, directed the petitioner to participate in the investigation by appearing before the 1st respondent police for preliminary enquiry. On such appearance, the respondent police was directed to proceed further based on the information collected. Alleging that the respondent police did not act upon the said direction, the present contempt petition has been filed.

The learned Government Advocate (Crl.Side) appearing for the respondent police has filed an affidavit stating that pursuant to the complaint of cheating against one Ramar, a case has been registered in Crime No.05 of 2023 and on completion of the investigation, a final report was filed before the Judicial Magistrate No.II, Mayiladuthurai. The Magistrate has taken cognizance of the final report on 07.05.2024 in C.C.No.122 of 2024, wherein, the present complainant has been cited as LW.8. Since the earlier complaint against the accused was already investigated and taken on file, the subsequent complaint in C.S.R.No.861 of 2024 was closed as 'Action dropped'. 4.
