CRIME NO.10 OF 2021 For Petitioner : M/S.M.SATHISH KUMAR Advocate For Respondent : M/S.S.KARTHIKEYAN, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offence under Sections 147, 148, 294(b), 323, 324, 307 and 506(ii) of IPC in crime No. 10 of 2021 on the file of respondent police, seeks anticipatory bail.

2. Totally there are five accused in this case and the petitioner is A4. It is alleged that the defacto complainant is running a road side shop and the petitioner along with other accused purchased some snacks in the shop and failed to pay the amount and the same was questioned by the defacto complainant. Due to which the petitioner and other accused attacked the defacto complainant and caused serious injuries to him. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner has not involved in any offence as alleged by the prosecution and the other accused said to have involved in the said offence. Hence he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional public prosecutor would submit that the petitioner is a rowdy element and he has cheated a poor vendor, that apart there are 3 previous cases pending against him. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5. Considering the fact that the petitioner is a rowdy element and there are three previous cases pending against him, this Court is not inclined to grant anticipatory bail to the petitioner.
