CMP.Nos.2477 of 2021, 6787, 6789 & 6790 of 2024 and in SA.No.110 of 2021 A.A.NAKKIRAN, J.

(i).C.M.P.No.2477 of 2021 is filed to grant interim injunction restraining the Respondents and their agents from any way alienating or creating encumbrance of the petitioner mentioned properties which is subject matter in OS.No.296 of 2010 on the file of the Honourrable Additional Subordinate Court, Tiruppur, pending disposal of the above Second Appeal.

(ii) C.M.P.No.6787 of 2024 is filed to condone the delay of 585 days in filing the petition to set aside the abatement.

(iii) C.M.P.No.6789 of 2024 is filed to set aside the abatement caused due to the death of 3rd Respondent i.e.Valliammal in S.A.No. 110 of 2021. (iv) C.M.P.No.6790 of 2024 is filed to bring on records the Respondents 4 and 5 as the Legal Representatives of the deceased 3rd Respondent i.e. Valliammal in S.A.No. 110 of 2021 (v) C.M.P.No.1750 of 2025 is filed to implead the proposed petitioners as respondents No.4 and 5 in S.A.No.110 of 2021.

2. Heard both sides.

3. The learned counsel appearing for the respondents has no objection to allow these petitions.

4. On being satisfied with the reasons stated in the accompanying affidavits filed https://www.mhc.tn.gov.in/judis

in support of these petitions and in view of no objection expressed by the learned counsel for the respondents, apart from CMP No.2477 of 2021, other applications are ordered as prayed for.

5. As CMP No.2477 of 2021 was filed in the year 2021 and the same has been pending till this date without any order. In the said circumstances, no useful purpose will be served in keeping this miscellaneous petition pending, at this length of time and hence, this Civil Miscellaneous Petition is closed. 6.Post the Second appeal for arguments on 09.06.2025.
