This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.P.K.Shiva Kumar, learned counsel for appellant and Mr.G.Mohanraj, learned counsel for the second respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter and filed a memorandum of settlement, which reads as follows: TERMS & CONDITIONS OF SETTLEMENT
1. The employer agrees to fix the time scale notionally on the date of completion of 480 days with effect from 01.01.2004 and agrees to pay the arrears of payment of time scale salary as per the circular issued by the Registrar of Co-operative Societies in Na.Ka.No.93630/2015 Va.A1(1) dated 08.11.2018 and the employee agrees for the same.
2. The employee agrees to give up all claim of back wages prior to 08.11.2018 and entitled to be paid back wages from 08.11.2018 till date with continuity of service.
3. The employer agrees to pay the back wages above said within a period of 4 weeks from the date of the order of the Hon'ble High Court of Judicature at Madras.
4. The employer agrees to file a copy of the settlement before the Lok Adalat and request the Lok Adalat to record the settlement and pass suitable orders in the terms of settlement.
5. The employer agrees no claim or back wages whatsoever against the employer and the employer also agrees that there is no claim whatsoever against the employee.
This writ petition is disposed of in the above terms. Connected miscellaneous petition is closed, if any.
